I don't know about .au, but in .us, that might fall under fair use. You
may also want to contact the publisher (usually the copyright holder on
the finished game) for confirmation. If they're defunct or otherwise
don't respond, I'd consider it fair game for fair use. Disclaimer:
IANAL (yet).
