[SBE] The EB vs KWVE

In an SBE meeting here in Atlanta the other night - a meeting dealing with
EAS - one of the quotes of the evening was "One of the points of doing a
test is to fail it sometimes." Anybody who knows a teacher knows that a
student who ALWAYS gets 100% on the test is going to look kind of suspect
after a while.

It does sound like there was some degree of over-zealousness occurring here
somewhere, although I obviously do not know the whole story. It would seem
that a lot of this issue could have been resolved more easily with better
communication. Assuming that this was not a recurring problem, than there
is a system in place to resolve this already: If it works I sign off on it;
if it doesn't work I explain why it didn't work and what I am doing to
resolve it. FCC is happy, GM is happy, nobody has to die. Of course... if
this was a recurring problem than the FCC legitimately has reason for
concern.

It does bring up an interesting thought though: For small broadcasters, $5K
is a pretty steep bill to pay for a mistake in a system you can opt out of -
especially in the current economy. However, the Behavioral Psychologist in
me says they shouldn't just *waive* the fine (if you're going to have a
system of reward and punishment for doing something work than you need
consistency - By ultimately waiving the fine you're making a system that a
lot of people already see as little more than a hassle seem even more
illegitimate). Perhaps expecting a $5K to be reasonable may be a stretch?
Maybe they should they have lowered it? I don't know... I'm hardly a
lawyer.

As Barry seems to be saying, there is a fine line between a deterrent from
doing something wrong and a deterrent from being involved in the first
place.
