[SBE] Forest Service woes

Clarification.

One small step we have been able to make in New Mexico.

We've successfully gotten several Forest Managers to understand that part 74
is not broadcast. It is similar to 2-way use, in that it is limited in
power and is specifically not the Broadast Service as defined by the FCC.

So -- part 74 users with less than 1,000 watts TPO have been and are being
allowed in many sites. Here in the west, that includes "Rocky Mountain
Alternative" Public Radio facilities -- which may be pushing the envelope,
but have been allowed in some sites, I'm told.

Translator installations in 2-way sites are common in our state.

I even know of one "less than 1000 watt carrier" part 73 installation in a
2-way site. There may be more. In our backyard, the concern seems to be
more about power than about class of service.

How did we get the translators included since on of the definitions of
permissible use in 2-way sites in our state has been "intermittant carrier?"

First, they were blocked by the Forest Service.

Then we pointed to NOAA weather transmitters, which are constant carrier.

The Forest Service accepted the precedent, and our services with 1000 watts
or less TPO were in were in! Note that some jurisdictions use ERP, not TPO,
but most use TPO.
