Substitute Motion under Article 28





I, A. Michael Ruderman, submit this Substitute Motion under Article 28:



To amend Article 2, Canine Control, of Title VIII, Public Health and Safety, of the Bylaws to change the number "six" to "twenty" as shown in bold below, and add the following underlined text:



Section 2. Leashing of Dogs



Leash Required

No person owning or keeping a dog in the Town of Arlington shall permit such dog to be at large in the Town of Arlington elsewhere than on the premises of the owner or keeper, except if it be on the premises of another person with the knowledge and permission of such other person. Such owner or keeper of a dog in the Town of Arlington, which is not on the premises of the owner or upon the premises of another person with the knowledge and permission of such person shall restrain such dog by a chain or leash not exceeding twenty (20) feet in length. In any prosecution hereunder, the presence of such dog at large upon premises other than the premises of the owner or keeper of such dog shall be prima facie evidence that such knowledge and permission was not had.

This provision shall not apply, however, in any area designated by the Board of Parks and Recreation Commissioners as a "Dog Park," "Dog Run" or "Dog Exercise Area." In areas so designated, dogs are not required to be restrained by a leash provided the owner or keeper of such dog is present and attentive to the dog.



This provision of the above Section 2 shall not apply, however, to Town-owned open spaces during

the hours of 7:00 to 9:00 am and 7:00 to 9:00 pm. During these hours, dogs are not required to be

restrained by a leash, provided the owner or keeper of the dog is present and attentive toward the dog and the dog is under effective control. Dogs must, however, be restrained by leash in proximity to a permitted sporting or other event.



And

To amend Article 1, Use of Areas Under Control of Park Department, of Title IV, Public Areas, of the Bylaws to change the number "six" to "twenty" as shown in bold below, and add the following underlined text:

Section 8. Animal Control
Art. 9, ATM, 4/28/03
No person shall cause or permit any animal owned by him or in his custody or under his control, to roam or be at large, in, on or through any park or playground, except in any area designated by the Board of Park and Recreation Commissioners as a "Dog Park", "Dog Run" or "Dog Exercise Area", or, except a dog when restrained by a leash not exceeding twenty (20) feet in length. No animals are allowed on any beach under the care and control of the Park Department.

Excepting any beach under the care and control of the Park Department, the provision of the above Section 8 shall not apply, however, to Town-owned open spaces during the hours of 7:00 to 9:00 am and 7:00 to 9:00 pm, During these hours, dogs are not required to be restrained by a leash, provided the owner or keeper of the dog is present and attentive toward the dog and the dog is under effective control. Dogs must, however, be restrained by leash in proximity to a permitted sporting or other event.
